Eymence LLC provides professional software development services, including but not limited to:

• Mobile application development (iOS and Android)
• Web application development and design

3. User Obligations and Conduct

When using our services, you agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials

4. Intellectual Property Rights

All content, features, functionality, software, and materials provided through our services are owned by Eymence LLC, its licensors, or other content providers and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

Unless otherwise specified in a separate written agreement, all custom software and solutions developed by Eymence LLC remain our property until full payment is received, at which point ownership rights transfer according to the terms of the project agreement.

5. Payment Terms

For services requiring payment:

• Payment terms will be specified in individual project agreements or invoices
• All fees are quoted in U.S. Dollars unless otherwise stated
• Late payments may incur additional fees as specified in the agreement
• We reserve the right to suspend services for non-payment
• Refund policies will be outlined in individual project agreements

6. Warranties and Disclaimers

Limited Warranty: We warrant that our services will be performed in a professional and workmanlike manner consistent with industry standards.

Disclaimer: EXCEPT AS EXPRESSLY PROVIDED IN A WRITTEN AGREEMENT, OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EYMENCE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use our services
• Any conduct or content of any third party on our services
• Unauthorized access, use, or alteration of your transmissions or content

Our total liability shall not exceed the amount paid by you to us in the twelve (12) months preceding the claim.

We understand that during the course of our business relationship, we may have access to confidential information. We agree to maintain the confidentiality of such information and not to disclose it to third parties without your consent, except as required by law or necessary to perform our services.

9. Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use our services will immediately cease.

10. Modifications to Service

We reserve the right to modify, suspend, or discontinue our services (or any part thereof) at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of our services.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Wyoming.

12. Dispute Resolution

Any disputes arising out of or relating to these Terms or our services shall first be attempted to be resolved through good faith negotiations. If negotiations fail, disputes shall be resolved through binding arbitration in Wyoming in accordance with the American Arbitration Association rules.

13. Indemnification

You agree to indemnify, defend, and hold harmless Eymence LLC and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of our services or your violation of these Terms.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of our services after such modifications constitutes your acceptance of the updated Terms.
